Learned counsel appearing on behalf of the petitioner submits that petitioner has already filed detailed representation before the Vice Chancellor, Patliputra University, Patna with respect to re-fixation of pension extending the benefit of three years of continious service for the purpose of fixation of pension in terms of Letter No. 1648, dated 29.06.2005, issued by the Chancellor Secretariat. Learned counsel further submits that similarly situated Associate Professor, whose name has figured at Serial No. 19, namely Dr. Purushottam Poddar, has been paid the benefit and petitioner is also entitled for similar treatment.

3. The Vice-Chancellor, Patliputra University is directed to dispose of the representation dated 14.05.2022 and reminder dated 24.02.2023, by passing a reasoned order and make payment of retiral dues including re-fixation of pension in accordance with law.

4. In case, the petitioner is entitled for the benefit as given to one Associate Professir namely Dr. Purushottam Poddar, then in that case the petitioner must be given equal

5. With the above observation and direction the writ petition stands disposed of.
