The petitioner seeks regular bail in connection with Mahindwara P.S. Case No. 10 of 2020 for the offence punishable under Sections 363/ 366(A) of the Indian Penal Code.

The allegation is regarding the victim girl having been kidnapped by the petitioner, while she was going to coaching at Fulwariya Chowk.

The learned counsel for the petitioner has submitted that the petitioner is innocent, has been falsely implicated in the present case, is having a clean antecedent and is languishing in custody since 29.07.2020. The learned counsel for the petitioner, by referring to the statement made by the victim girl under

Patna High Court CR. MISC. No.35768 of 2020(2) dt.19-01-2021 2/2 Section 164 Cr. P. C. before the learned Magistrate, has also submitted that the victim girl has stated in her statement that nobody had abducted her and she had voluntarily married the petitioner herein as also she has been living with him as husband and wife.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the parties and taking into account the statement of the victim girl made under section 164 Cr. P.C. before the learned Magistrate, I deem it fit and proper to direct for release on the petitioner on regular bail.

Accordingly, the petitioner, above-named is directed to be released on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge, 6th cum Special Judge, Sitamarhi in connection with Mahindwara P.S. Case No. 10 of 2020.
