Six petitioners, apprehending their arrest in connection with Complaint Case no.910 of 2014 for the offence under Sections 323, 379, 354 of the Indian Penal Code, have prayed for grant of anticipatory bail.
Learned counsel for the petitioners submits that on perusal of the complaint petition itself, it is evident that the land
Patna High Court Cr.Misc. No.22536 of 2016 (2) dt.20-05-2016 2/2 dispute in between the parties is going on and, as such, he submits that falsely, the petitioners have been made accused, whereas Sri Narendra Kumar Singh, learned Addl. Public Prosecutor has opposed the prayer of the petitioners. He submits that in the complaint petition, there is specific accusation against the petitioners.
Be that as it may, keeping in view the nature of accusation, let the petitioners , namely, (i) Surya Narayan Mandal (ii) Shyam Mandal (iii) Binod Mandal @ Binod Kumar (iv) Deep Narayan Mandal (v) Shambhu Mandal and ( vi) Gajendra Singh, in the event of their arrest or surrender within a period of six weeks from today, be released on bail on furnishing bail bond of Rs.10, 000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of Shri J.K. Kashyap, learned Judicial Magistrate, 1st Class, Madhepura in connection with Complaint Case no.910 of 2014, subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure (Rakesh Kumar, J) NKS/- U
