JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged that the wife of the informant went outside to ease out when on hearing the sound of gunshot, the informant came out and found his wife in a pool of blood with firearm injury which was suspected against the petitioner since the petitioner earlier threatened to kill the victim, as she played witch craft on the family members of the accused persons.

It is submitted by counsel for the petitioner that except suspicion, no evidence has been collected against the petitioner. The impugned order also does not suggest any material except suspicion raised against the petitioner. A statement has been made

Patna High Court Cr.Misc. No.2073 of 2015 (2) dt.19-01-2015 2/2 in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya in connection with Moffasil P.S. Case No. 214 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
