2 The petitioner has preferred this application for grant of regular bail in connection with Siswan PS Case No 179 of 2020 dated 18.12.2022 registered for the offence punishable under Sections 147, 341, 323, 302/120B of the IPC. 3 As per the prosecution case, the petitioner and the co-accused persons caught hold of the informant's son and the co-accused Sonu Kumar Singh and Mithilesh Kumar Singh inflicted blows of knife on the son of the informant and due to that he died.

4 Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.39393 of 2023(2) dt.24-07-2023 2/2 this case. The petitioner bears one criminal antecedent, as stated in paragraph 3 of the bail petition in which he is on bail. It is further submitted that the co-accused Ram Pravesh Singh has already been granted bail by the co-ordinate Bench of this Court vide order dated 06.12.2021 passed in Cr Misc No 29079 of 2021. He is in custody in this case since 07.11.2022. 5 Learned APP has vehemently opposed the bail petition of the petitioner.

6 Considering the aforesaid facts and circumstances of the case, the period of custody as well as the nature of allegation against the petitioner, the petitioner above named is directed to be released on bail on his furnishing bonds of Rs 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of ACJM IV, Siwan in Siswan PS Case No 179 of 2020 dated 13.08.2020. 7 This application stands allowed.
