2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Parbatta P.S. Case No. 126 of 2024 instituted for the offence under Section 103(1) of the BNS.

3. The case of the prosecution is that the son of the informant has gone outside of the house on his bike along with his friend but he did not return. On search, his dead body was found. During investigation the informant revealed that his son used to talk with accused Komal Kumari.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Learned counsel submits that the petitioner is cousin of

Patna High Court CR. MISC. No.39201 of 2025(2) dt.01-07-2025 2/2 Komal Kumari. It is also submitted that similarly situated coaccused, namely, Kiro Yadav @ Akhilesh Yadav has been granted anticipatory bail by the learned Co-ordinate Bench of this Court vide Cr.Misc. No.20028 of 2025. The case of this petitioner stands on similar footing.

5. In contra, learned APP appearing for the State has no objection in the argument that similarly situated co-accused has been granted bail by the learned Co-ordinate Bench.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Parbatta P.S. Case no. 126 of 2024, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate II, Naugachia, Bhagalpur subject to the conditions as laid down under section 438(2) of the Cr.P.C.
