This application for regular bail arises out of Bisfi P.S. Case No. 114 of 2020, disclosing offence punishable under Section 307 and other allied Sections of the Indian Penal Code. It is alleged that the FIR named accused persons were pressurising the informant's father to withdraw a criminal case filed by him. It is further alleged that the miscreants had started abusing and assaulting the informant and his father. There is allegation against the petitioner of having hit the informant's father with an axe causing grievous injuries. The petitioner is in custody since 10.04.2020.
Learned counsel appearing on behalf o the petitioner has submitted that existing animosity between the parties is the
Patna High Court CR. MISC. No.35713 of 2020(5) dt.22-02-2021 2/2 apparent reason behind the alleged occurrence leading to lodging of the FIR. He has further submitted that it is evident from the FIR that there is no allegation of repetition of blow by the petitioner, and, therefore, intention to murder is absent. Considering the aforesaid submission and the fact that the petitioner is in custody since 10.04.2020, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned A.C.J.M. Ist, Benipatti, Madhubani, in Bisfi P.S. Case No. 114 of 2020.
