The petitioner seeks bail in Alauli P.S. Case No. 130 of 2021, registered for the offence punishable under Sections 302, 120(b)/34 of the Indian Penal Code.

As per prosecution case, on 09.04.2021 at about 11.00 am informant (Chowkidar) got information that Raj Kishor Sahu was shot dead by Ajay Kumar (younger brother of Raj Kishor Sahu) and his wife (Nirmala Devi). Thereafter he informed the police, leading to registration of present FIR. It is submitted on behalf of the petitioner that there is no eye-witness of the occurrence. Petitioner has been made accused due to village politics. During course of investigation, name of villagers from whom Chowkidar got information about the alleged occurrence has not been disclosed. Patna High Court CR. MISC. No.48252 of 2021(2) dt.23-11-2021 2/2 of deceased and sister-in-law (Bhabhi) of the co-accused Ajay Kumar. Petitioner has got three child from the wedlock of the deceased one of them is a little baby and another is a student and living at Khagaria for preparation of competitive examination. Petitioner claims clean antecedent and she is in custody since 30.06.2021. Investigation is complete. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Alauli P.S. Case No. 130 of 2021.
