JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 13-03-2015 Both the applications arise out of Manigachhi P.S. Case No. 85 of 2014 instituted under diverse provisions of the Penal Code including section 307. They have been thus made analogous.

Heard Mr. Pandey for the petitioner(s) and the counsel for the informant.

Patna High Court Cr.Misc. No.39148 of 2014 (2) dt.13-03-2015 2 / 3 The petitioners herein are wife and mother of the co accused Amar Nath Mahto who along with petitioners assaulted the mother and Bhabhi of the informant on account of land disputes.

The contention of the petitioners is that they are family members and there is no direct allegation of assault attributed to them. The allegation is vague and general. Earlier to this Amar Nath Mahto had lodged a case against the informant and others under section 307 IPC and the present case is counterblast of the said case. In the facts and circumstances of the case, petitioners abovenamed in the event of arrest/surrender within four weeks from today shall be released on bail on furnishing bail bond of Rs. 10,000/- each, with two sureties of the like amount each to the satisfaction of Shri A. Kunal, J.M. 1st Class, Darbhanga in connection with Manigachhi P.S. Case No. 85 of 2014 subject to the condition that one of the bailors shall be own/close family member of each of the petitioners. In the event of framing of charge the petitioners shall appear in person on each date fixed at the trial. In case of default in doing so on two consecutive dates the trial court shall cancel
