ANJANA MISHRA ORAL ORDER 11-08-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner apprehending his arrest in connection with Bagaha P.S. Case No. 385 of 2014 registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code. Allegation against the petitioner is that he was carrying wood along with one Bhulan Singh and the driver of the truck after taking payment of plywood which allegedly ran away with the amount which was received by way of payment. The further allegation against the petitioner is that while the said Bhulan Singh had gone to attend the call of nature after leaving the money in his hand the petitioner escaped with the same and could not have been found.

In view of the nature of allegation made and the

Patna High Court Cr.Misc. No.21413 of 2016 (3) dt.11-08-2016 2/2 materials which has surfaced in the case diary, I am not inclined to grant anticipatory bail to the petitioner.

However, if the petitioner surrenders in the learned Court below his case shall be considered without being prejudiced by this order.
