The petitioner Malti Devi apprehends her arrest in Belaganj P.S. Case No. 88 of 2014, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.
The father of the deceased alleged that his daughter was brutally assaulted by her husband and other in-laws in the night of 27.06.2014.
Learned counsel for the petitioner submits that the petitioner is mother-in-law of the deceased Uganti Devi. Uganti Devi was married to Dilip Yadav 15 years ago. She got three children. The informant alleged that he came to know through his grand-daughter that there was some altercation between the
Patna High Court Cr.Misc. No.3721 of 2015 (2) dt.28-01-2015 deceased and her sister-in-law, on such the husband of the deceased assaulted the deceased. It is further submitted that the sister-in-law of the deceased has already been granted anticipatory bail.
Considering the facts aforesaid and the fact that the petitioner is mother-in-law of the deceased and no specific allegation is made against the petitioner, she, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Belaganj P.S. Case No. 88 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
