JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 07-04-2015 The present writ petition has been filed for issuance of a direction to the respondents-authorities to take action against the accused persons of Bachhawara P.S. Case No.161 of 2012 and to investigate the case fairly and properly.
2. Learned counsel for the petitioner submits that despite the first information report having been instituted as far back as in 2012, respondents-authorities are not carrying investigation in proper manner in discharge of their official duties.
3. Learned counsel for the State, on the other hand, relies
Patna High Court Cr. WJC No.400 of 2014 dt.07-04-2015 2/2 on the counter affidavit to submit that investigation of the case has been progressing and is on the verge of completion. In course of investigation, no direct or indirect evidence has been found against 14 accused persons whereas the case has been found true only against accused Ram Kumar Choudhary alias Kari, who is absconding. A direction has been given to the Investigating Officer to submit charge sheet against the said accused after declaring him as absconder.
4. Having regard to the entirety of the facts and circumstances of the case and in view of the stand of the respondents, it is expected that charge sheet would be expeditiously filed. The writ petition stands dismissed.
