KUMAR ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 11-08-2022 Petitioner has prayed for the following relief(s): "(i) For issuance of an appropriate writ in the nature of Certiorari for quashing the order No. 69 dated 27.05.2022 passed by respondent Chief Engineer whereby and whereunder respondent Chief Engineer was pleased to cancel the agreement of petitioner bearing agreement No. 117SBD of 2018-19 dated 19.11.2018 with respondent authority and also pleased for fit the amount of performance security.

(iii) Further for direction to the respondent authority to make refund the forfeited amount to performance security to the petitioner.

(iv) Further for issuance of any other writ/writs, order/orders, direction/directions for which petitioner shall be found entitled under the facts stated herein below."

In view of the fact that Bihar Public Works Dispute Arbitration Tribunal is now functional, learned counsel for the petitioner, under instructions, seeks permission to withdraw the present petition with liberty to take recourse to such other appropriate remedies, as are otherwise available, in accordance with law.

Permission granted.

As and when any such request is made by the petitioner before the Tribunal, the same shall be considered and decided expeditiously.

The petition stands disposed of as withdrawn with the liberty aforesaid.
