JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 01-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners seek anticipatory bail in a case registered for the offences punishable under Sections 341, 323, 307, 504/34 of the Indian Penal Code.

It is submitted with reference to the First Information Report that there is no specific allegation of any overt act against these petitioners causing any injury upon the informant. It has further been submitted that the petitioners and the informant belonged to the same family and because of dispute over partition, the First Information Report has been instituted. Petitioner Nos. 1 and 2 are wives of the brothers of the

Patna High Court Cr.Misc. No.38474 of 2014 (2) dt.01-04-2015 informant, whereas petitioner no.3 is the son of the brother of the informant.

Learned counsel appearing on behalf of the petitioners appears to be right in his submission that partition dispute over partition is the reason behind institution of the present case. In view of the submission as above, let petitioners above named in the event of their arrest/surrender within four weeks from today in the court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Khjijarsarai P.S. Case No. 132 of 2014, subject to the conditions as laid down under Section 438(20 of the Code of Criminal Procedure. (Chakradhari Sharan Singh, J) ArunKumar/- U
