The petitioner, apprehending his arrest in a case registered for the offence punishable under sections 341, 323, 504 of the Indian Penal Code and Section 3(1)(x)(xi)(xii) SC/ST (POA) Act, is solitary named accused in this case with specific accusation of misbehaving with the lady from whom some articles were taken and money is avoided to be paid. Submission is of false implication in retaliation of one complaint case filed by cousin of the petitioner against others including husband of the informant but there is even no whisper about the receipts as mentioned in the fardbeyan.
Having regard to the facts and circumstances of the case, the petitioner appears not entitled for the privilege sought. Accordingly, the prayer for anticipatory bail of the abovenamed petitioner, in connection with Saran SC/ST P.S. Case No.46
Patna High Court Cr.Misc. No.36399 of 2014 (2) dt.11-02-2015 2/2 of 2013 pending in the court of learned Judicial Magistrate, 1st Class Saran at Chapra, is hereby refused with a direction to the petitioner to surrender before the court below within a fortnight and seek regular bail, which shall be considered on its own in accordance with law.
