The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a) and 30(d) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, on information having been received a raid was conducted and various articles for manufacture of liquor as also 80 litres of mahua liquor was recovered. The petitioner was identified amongst the accused persons who had managed to escape.

It is submitted by learned counsel for the petitioner that neither the petitioner was arrested at the spot nor any incriminating article has been recovered from his possession. He has been falsely implicated in the case because of his antecedent and village rivalry. The petitioner is in custody since

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner not having been arrested at the spot and having remained in custody for more than 8 months, the petitioner is directed to be enlarged on bail in connection with Sirdala P.S. Case no. 184 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge II - cum - Special Judge, Excise Act, Nawada.
