JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-06-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Siwan Muffasil P.S. Case No. 388 of 2015 registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code.

It is alleged that petitioners and other F.I.R. named accused demanded Rangdari and when their demand was not fulfilled, they opened fire on the informant, who luckily escaped unhurt and thereafter petitioners and their associates took the iron gate and other articles from the place of occurrence. Contention on behalf of the petitioners is that there

No.24687 of 2016 (2) dt.14-06-2016 2/2 was land dispute between the parties in respect of lands in question and as a matter of fact, title suit as well as proceeding under Section 144 of the Cr.P.C. were also pending at the time of institution of the present case. It is further submitted that coaccused, Sachin Kumar Singh @ Munna Singh and Yogesh Kumar Singh @ Tachchu Singh, having more or less similar allegation, have already been granted privilege of anticipatory bail by a co-ordinate Bench of this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in Siwan Muffasil P.S. Case No. 388 of 2015 subject to condition as laid down under Section 438(2) of the Cr.P.C.
