2. The petitioner apprehends his arrest in connection with Kanti P.S. Case No. 56 of 2023 instituted for the offences under Sections 363, 366A of the Indian Penal Code.
3. Prosecution case, in short, is that the daughter of the informant left the house for coaching and thereafter did not return. The informant further alleged that earlier the accused persons including the petitioner had threatened the informant
Patna High Court CR. MISC. No.42450 of 2024(2) dt.26-06-2024 2/3 and for which a case was registered. The informant suspects that the accused persons have kidnapped her daughter.
4. Learned counsel for the petitioner submitted that the petitioner is innocent and has falsely been implicated in the present case due to previous grudge and dirty village politics. Learned counsel further referring to paragraph- 7 of the bail application submitted that the victim girl has been recovered along with one Pankaj Kumar and her statement was recorded under Section 164 of the Cr.P.C. in which she has shown her willingness to go with her husband Pankaj Kumar after executing a bond. The co-accused persons have already been granted regular bail by the co-ordinate Bench of this Court vide Annexure-P/2 Series to the present bail application. It has been submitted on behalf of the petitioner that the petitioner has one criminal antecedent.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances of the case, let the petitioner above named, in the event of arrest/surrender before the learned Court below within a period of six months from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two
