The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 336.06 litres of liquor was recovered from the hut belonging to one Munna Chauhan. It is stated that some of the accused managed to escape and the petitioner was identified amongst the accused who had escaped. It is submitted by learned counsel for the petitioner that neither the petitioner was arrested at the spot nor any incriminating article recovered from his possession. The cause of false implication of the petitioner is his antecedent. He is in custody since 19.4.2021 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case specially the petitioner having remained in custody for 1 year, the Court directs the petitioner to be enlarged on bail in connection with Itarhi P.S. Case no.15 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge II-cum-Special Judge, Excise, Buxar.
