During execution of MANREGA Scheme petitioner along with other co-accused have been identified who had syphon the money by playing malpractice, fraud.
Adverting to the show cause filed by the petitioner, a J.E, it has been submitted on behalf of petitioner that he has got no complicity in syphoning the amount but even during departmental proceeding if any amount is found due against him, he is ready to deposit the aforesaid amount.
The learned Additional Public Prosecutor fairly concedes.
In the aforesaid event petitioner, Bijay Prakash is directed to be released on bail on furnishing bail bonds of
Patna High Court Cr.Misc. No.40708 of 2013 (2) dt.24-12-2013 Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Nathnagar (Madhusudanpur) P.S. Case No.118 of 2013 in the event of his arrest or surrender within four weeks in terms of Section 438(2) Cr.P.C. However, it is made clear that necessary steps should taken up by the Department in this regard and in case petitioner is found responsible then in that event the petitioner be served with due to which he will deposit within three months from today. To have the paraphernalia completed within the aforesaid stipulated period, let a copy of this order be served upon District Magistrate, Bhagalpur. (Aditya Kumar Trivedi, J) PN/-
