1. Heard Mr. Mrigendra Kumar, learned counsel for the petitioners and Mr. Mohammad Sufyan, learned APP for the State.

2. The petitioners apprehend their arrest in connection with Belaganj P. S. Case No. 449 of 2024 dated 21.07.2024 registered for the offence(s) punishable under Section(s) 139 and 3(5) of the B.N.S.

3. The main submissions advanced by the petitioners' counsel are that though the instant matter relates to kidnapping of informant's daughter but the said allegation is based on suspicion raised by the informant and the same is against the son of the petitioners and not against the petitioners and petitioners have been made accused mainly on account of not cooperating the informant in the search for so-called victim

Patna High Court CR. MISC. No.39538 of 2025(2) dt.27-06-2025 2/2 except this there is no allegation against them. It is further submitted that the petitioners have fair and clean antecedent. It is lastly submitted that the so-called victim has been recovered and she has recorded her statement under Section 183 of the B.N.S.S., 2023 and wherein, she affirmed her love affair with the son of the petitioners and stated that the petitioners had no role in her leaving the custody of her parents.

4. Learned APP appearing for the State has opposed the bail prayer of the petitioners.

5. Considering the aforesaid submissions advanced by petitioners' counsel this court is inclined to grant the relief of anticipatory bail to the petitioners. Accordingly, let the petitioners named-above, in the event of their arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail in connection with Belaganj P. S. Case No. 449 of 2024 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the Court concerned, subject to the conditions as laid down under Section 482(2) of the B.N.S.S.
