JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 15-12-2017 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

The grievance of the petitioner is non-consideration of the case for compassionate appointment.

Counsel appearing on behalf of the petitioner submits that father of the petitioner died in harness on 5.5.2013. He was a Peon in Govt. High School, namely, Uma Devi Mishra Girls High School, Katihar.

Patna High Court CWJC No.16557 of 2017 (2) dt.15-12-2017 2/3 has already submitted an application for consideration of his case for compassionate appointment which was duly forwarded by the Principal of the school on 12.12.2013 but the respondents are adopting dilly-dally in the matter of compassionate appointment of the petitioner.

Referring to Annexure-2 he submits that the necessary document alongwith the application of the petitioner was forwarded by the Principal of the school in question on 4.1.2014 to the District Programme Officer (establishment), Katihar but respondents have not decided the claim of the petitioner for compassionate appointment.

Considering the totality of facts situation, the writ petition is disposed of with direction to the respondent no.5, District Programme Officer(establishment), Katihar to look into the grievance of the petitioner and take final decision with regard to the compassionate appointment of the petitioner by placing the case of the petitioner before the appropriate committee/authority within a maximum period of three months from the date of receipt/production of a copy of this order, the respondents are required to take final decision one way or the other within the aforesaid period of three months from the date communicated hereinabove.
