JUSTICE ARUN KUMAR JHA ORAL ORDER 15-04-2024 The instant petition has been filed for setting aside the judgment and decree dated 18.03.2020 and 27.03.2020, respectively passed by learned Additional District Judge-IVth, Darbhanga, whereby the learned Additional District Judge has remanded the matter back to the learned trial court for fresh consideration.

2. Learned counsel for the petitioners submits that since against the judgment and decree of learned Additional District Judge, Misc. Appeal under Order 43 Rule 1(u) is maintainable, he may be permitted to convert the present Civil Misc. Petition into Misc. Appeal.
