1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of anticipatory bail apprehending his arrest in connection with Alamganj P.S. Case no. 799 of 2024, registered under sections 316(2), 318(1), 352 and 351(2) of the Bhartiya Nyaya Sanhita, 2023.

3. As per the prosecution case, the informant states that the petitioner who happens to be his brother-in-law (sarhu) took a sum of Rs.89,700/- through G-pay to provide him accessories including gyser, double-door fridge etc., however the same was not provided. On the informant asking the petitioner to return the amount, the same was also not returned.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. The allegations levelled are false and concocted. It is submitted that

No.36665 of 2025(2) dt.05-06-2025 2/2 the petitioner and the informant are own brother-in-law (sarhu) and there are cases pending between them relating to property dispute including Title Suit no.44 of 2021 etc as mentioned in the petition. The petitioner has no criminal antecedent.

5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

6. Having heard learned counsel for the parties and taking into consideration the nature of allegation levelled against the petitioner, the relationship between the parties and the pending litigation as given in detail in different paragraphs of the petition together with the petitioner not having any criminal antecedent, it is directed that the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Alamganj P.S. Case no. 799 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M- IV, Patna City, DistrictPatna.
