2. The petitioner seeks bail in a case registered for the offence punishable under Sections 8(c), 20(b)(ii)(B) and 29 of the Narcotic Drugs and Psychotropic Substances Act.
3. As per prosecution case, 3.200 Kgs of Ganja like substance was recovered from the house of this petitioner.
4. It is submitted by learned senior counsel for the petitioner that petitioner is quite innocent and has committed no offence. No incriminating article has been recovered from conscious possession of this petitioner and has been made an accused in this case merely on suspicion. Moreover, the alleged recovered contraband is less than commercial quantity. Chargesheet has already been submitted and petitioner is in custody
Patna High Court CR. MISC. No.37231 of 2025(3) dt.19-09-2025 2/2 since 23.04.2025. Petitioner claims clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the facts and circumstances of the case, nature of accusation, period of custody and clean antecedents of the petitioner, the prayer for grant of bail to the petitioner is allowed.
7. Accordingly, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Principal Sessions Judge, Sheohar in connection with Purnahiya P.S. Case No. 117 of 2024. (Prabhat Kumar Singh, J) shashank/- U T
