The petitioner apprehends his arrest in Turkaulia P.S. Case No. 405/15 registered under Sections 302, 120(B) of the Indian Penal Code.

The informant named the petitioner and alleged that the petitioner and others took his father and Juman Khagni to participate in a Barat party but they were killed. It is submitted that there is no eye witness of the occurrence. The petitioner has falsely been implicated in the case.

On the other hand, learned counsel for the informant and learned A.P.P. have opposed the prayer for anticipatory bail. There is specific allegation that the petitioner along with others took both the deceased and thereafter they were killed.

Patna High Court Cr.Misc. No.22558 of 2016 (3) dt.16-08-2016 2/2 The petitioner has got criminal antecedents. Regular bail of a similarly situated co-accused Kalimullah @ Sk. Kalimullah has already been rejected vide order passed in Cr. Misc. No. 45740/2015.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail in Turkaulia P.S. Case No. 405/15. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) Dilip/- U T
