JUSTICE SATYAVRAT VERMA ORAL ORDER 25-01-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in connection with Manjha Garha P. S. Case No.308 of 2019, instituted for the offences under Section 304(B)/ 34 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is in custody since 05.01.2021, he is a person with clean antecedent and charge-sheet has been submitted in the case.

The learned counsel for the petitioner submits that the informant in the F.I.R. alleges that his daughter was married according to Hindu rituals on 12.03.2019 with Shatrughan Kumar and at the time of Bidai, a motorcycle was demanded and it is alleged that due to non-fulfilment of the same, his

The learned counsel for the petitioner submits that petitioner is the elder brother-in-law of the deceased and the husband is in custody and as far as allegation of dowry is concerned, the allegation is general and omnibus as regard this petitioner.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody since 05.01.2021, he is a person with clean antecedent, chargesheet has been submitted in the case, petitioner is the elder brother-in-law of the deceased and the husband is in custody, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gopalganj in connection with Manjha Garha P. S. Case No.308 of 2019.

The application stands allowed.
