JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-05-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 143,341,353,332,224 and 225/34 of the Indian Penal Code. It is alleged that the police apprehended petitioner no. 1, accused in Raxaul P.S. Case No. 7 of 2016 when the accused persons including petitioner nos. 2 to 4 got him released. It is submitted by the learned counsel for the petitioners that petitioner no. 1 has been granted anticipatory bail in Raxaul P.S. Case No. 7 of 2016 vide Cr. Misc. No. 16567 of 2016. Considering the nature of accusation, this court is not
Patna High Court Cr.Misc. No.23679 of 2016 (2) dt.26-05-2016 2/2 inclined to grant anticipatory bail to petitioner no. 1. Let the learned court below consider the prayer for regular bail of the petitioner no. 1 in case he surrenders within six weeks from today in connection with Raxaul P.S. Case No. 47 of 2016 pending in the court of learned S.D.J.M. Raxaul, East Champaran. So far as petitioner nos. 2 to 4 are concerned, since the accusation is omnibus and general, let them be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Raxaul, East Champaran in connection with the aforementioned case subject to the conditions as laid down under Section 438(2) Cr.P.C.
This application is disposed of with the aforesaid observation/direction.
