The petitioner wants to renew his prayer of bail, which was earlier rejected vide order dated 05.01.2016 passed in Cr. Misc. No. 45515 of 2015 on the ground that the petitioner is in custody since 13.07.2015 but up-till-now only three prosecution witnesses have been examined and all have turned hostile, the petitioner has been implicated due to previous enmity to which learned APP opposes by submitting that the victim girl in her statement recorded under Section 164 Cr.P.C. has supported the allegation of kidnapping as well as of rape against the petitioner. In the facts and circumstances stated above, finding no good ground for reconsideration of prayer for bail of the petitioner, again his prayer for bail in connection with
Patna High Court Cr.Misc. No.24501 of 2016 (2) dt.22-06-2016 Singheshwar P.S. Case No. 115 of 2015 pending in the court of learned Ist Additional Sessions Judge, Madhepura stands rejected. However, learned trial court is directed to expedite the trial and conclude the same as early as possible, preferably within four months from the date of receipt/production of a copy of this order after taking all positive steps for securing the attendance of rest prosecution witnesses.
