JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 13-03-2023 The present petition has been filed to renew the prayer for grant of bail to the petitioner which was earlier twice rejected vide orders dated 04.08.2021 and 18.01.2020 passed in Cr. Misc. No. 20119 of 2021 and Cr. Misc. No. 86704 of 2019 respectively.

In pursuance to the direction of this Court vide order dated 16.11.2022, a report with regard to the present stage of the case has been received and it has been kept at Flag-A. The report of the learned I/C Additional District & Sessions Judge-III, Gaya dated 25.11.2022 suggests that charges have been framed in the matter but no witness has yet been examined.

Patna High Court CR. MISC. No.41514 of 2022(5) dt.13-03-2023 2/2 It is submitted by learned counsel for the petitioner that petitioner is in custody since 28.06.2019 and up-till now no prosecution witness has been examined.

Taking into consideration the recovery of 100 Kgs of Ganja from a vehicle which was driven by the petitioner, this Court is not inclined to grant privilege of bail to the petitioner for the present. The prayer for grant of bail to the petitioner stands rejected. The Trial Court is directed to expedite the trial and conclude the same positively within a period of six months from today.

The petitioner will be at liberty to renew his prayer for bail if the trial is not concluded within a period of six months.
