JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-01-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 353, 341, 324, 427, 337 and 338/34 of the Indian Penal Code. It is alleged that the son of petitioner no.1 namely Sadique was apprehended in a case registered for the offences punishable under Sections 366A and 376 of the IPC when these petitioners being the father and brothers of Sadique got him released from the police custody, pelted stones and damaged the vehicle of the police.

It is submitted by learned counsel for the petitioners that the raid was laid by the police in the night which was protested as

Patna High Court Cr.Misc. No.2076 of 2015 (2) dt.19-01-2015 2/2 a result of which, the accusation has been levelled. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.

The aforesaid facts constitute good ground for consideration of regular bail.

Let the learned court below consider the prayer for regular bail of the petitioners if they surrender within a period of six weeks in connection with Kishanganj P.S. Case No. 285 of 2014 pending in the court of learned CJM, Kishanganj. Accordingly, the application is disposed of.
