JUSTICE AKHILESH CHANDRA ORAL ORDER 11-02-2015 Heard learned counsel for the petitioners, learned counsel for the informant and learned Additional Public Prosecutor for the State. The petitioners, who apprehend their arrest in connection with a case registered for the offences punishable under Sections 147, 149, 353, 341, 504, 506, 337/34 of the Indian Penal Code and Section 3(i) (x) of the SC/ST (POA) Act, are named accused in this case with allegation of causing nuisance with the school authorities and abusing. Submission is of false implication but fail to justify what for they were present there if any students of the school were called for the benefits of dress allowance etc. and whether their works, if any qualified for such benefits.
Having regard to the facts and circumstances, the petitioners appear not entitled for the privilege sought. Hence, their prayer for anticipatory bail, in connection with Bakhtiarpur P.S. Case No.15 of 2014, pending before the Judicial
Patna High Court Cr.Misc. No.36446 of 2014 (2) dt.11-02-2015 2/2 Magistrate, 1st Class, Saharsa is hereby refused with a direction to all the petitioners abovenamed to surrender before the Court below within a fortnight and seek regular bail where their prayer for regular bail shall be considered and disposed of on its own merit, in accordance with law.
