The petitioner apprehends his arrest in K. Nagar P.S. Case No. 399 of 2014, registered for the offences punishable under Sections 420 and 406 of the Indian Penal Code. Allegation against the petitioner is that the petitioner took Rs. 35000/- from the informant to get his name mutated in the year 2013 but in the year 2014 revenue Karmchari was transferred and Mohan Singh the petitioner, thereafter demanded Rs. 15000/- more money for getting the name of the informant mutated.

It is submitted that the petitioner is a student, he was imparting tuition to the son of the informant and on account of non-payment of fees this case has been lodged.

Patna High Court Cr.Misc. No.1796 of 2015 (2) dt.15-01-2015 Considering the facts aforesaid and the fact that there is no chit of papers to show that the petitioner received any amount from the informant, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt. Shachi Mishra, the learned Judicial Magistrate, 1st Class, Purnea in connection with K. Nagar P.S. Case No. 399 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
