JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-06-2022 At the outset of argument, learned counsel for the petitioners seeks permission to withdraw the anticipatory bail petition of petitioners No. 3, Shekh Pappu, 4. Shekh Mumtaz @ Chhuri and petitioner No. 5. Sohail Ansari.
Prayer is allowed.
The anticipatory bail petition of petitioners No. 3, 4, 5 is dismissed as withdrawn.
Heard learned counsel for the petitioners No. 1, 2 and 6 and the State.
Petitioners apprehend their arrest in a case registered for the offence punishable under Section 307 and some other allied Sections of the Indian Penal Code and u/s 27 of Arms Act. As per the prosecution case, petitioner No.1 is alleged
Patna High Court CR. MISC. No.48703 of 2021(2) dt.21-06-2022 2/2 to have assaulted the informant with Farsa and petitioner No.2 and 6 are alleged to have assaulted the informant and others by means of Lathi.
Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case. The injuries are reported to be simple in nature. There is case and counter case. Petitioners have got clean antecedent. Learned counsel appearing for the State opposes the prayer for anticipatory bail.
Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioners No. 1, 2 and 6, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Siwan in connection with Siswan (M.H. Nagar) PS case No. 102/2021, subject to conditions laid down u/s 438(2) of the Cr. P. C.
