JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 20-02-2021 Heard learned counsel for the petitioner and Mr. Chandra Bhushan Prasad, learned A.P.P. for the State. The petitioner in his second attempt is seeking regular bail in connection with S.Tr. No. 120/2016 and 100/2020 arising out of Navinagar P.S. Case No. 75 of 2015 registered for the offences punishable under Section 302 of the Indian Penal Code and Section 27 of the Arms Act.

Earlier prayer for bail of the petitioner has been rejected vide order dated 08.04.2016 passed in Cr. Misc. No. 14647 of 2016.

Learned counsel for the petitioner submits that the petitioner is in custody since 18.09.2016 and the trial is not progressing well.

Having regard to the facts and circumstances of the case, wherein it appears from the earlier order passed by a learned coordinate Bench of this Court that petitioner is allegedly the main assailant and then the trial is almost at the fag end, the prosecution evidence are already going on, this Court is not inclined to grant privilege of regular bail to the petitioner. Let the trail be concluded preferably within a period of six months from today.

This application is disposed of accordingly.
