The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 363, 366A of the Indian Penal Code.
The prosecution case is of abducting the minor daughter of the informant by Ranjan Kumar. It is alleged against petitioners that they facilitate the abduction being the family members of Ranjan Kumar.
It is submitted by the learned counsel for the petitioners that petitioners are the brother, brother's wife and mother of Ranjan Kumar, hence, they have been roped in the present case. In 164 Cr.P.C. statement the victim got her age
Patna High Court Cr.Misc. No.23089 of 2016 (2) dt.23-05-2016 recorded as 15 and half years, the Court assessed her aged 16 years, where she stated that Ranjan Kumar took her and married with her. The victim has not alleged anything against the petitioners.
Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No. 44 of 2016, subject to conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) P.K./- U T
