ANJANA MISHRA ORAL ORDER 23-08-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 420/465/467/468/471 of the Indian Penal Code. Allegation against these petitioners is that, they were appointed as Block Teacher on the basis of a forged letter
Patna High Court Cr.Misc. No.23846 of 2016 (4) dt.23-08-2016 P2/3 purported to have been issued in their favour and on the basis of such a letter, these petitioners were called for verification of documents and thereafter, they were taken in appointment as Prakhand Teachers.
Learned counsel for the petitioners submits that these petitioners have no role whatsoever to play in the issuance of the said forged letter which had come from the office of the Block Development Officer, Baniyapur and, thereafter, if at all, there was any illegality, it was at the hands of the said Block Development Officer, Baniyapur. The said fact is evident from Annexure- 6 series of the supplementary affidavit filed by the petitioners.
Having heard learned counsel for the petitioners and learned counsel appearing on behalf of the State and considering the nature of allegations and also the fact that now these petitioners have already been delinked from service, let the petitioners abovenamed, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Chapra, Saran, in connection with Baniyapur P.S. Case No.
Patna High Court Cr.Misc. No.23846 of 2016 (4) dt.23-08-2016 P3/3 57/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
