JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 29-07-2019 The petitioner seeks a direction to the respondents to demarcate the land, description of which has been given in paragraph 1(i) of the writ application. It is his case that he has filed a petition before the Office of the Circle Officer, Banma

Patna High Court CWJC No.15248 of 2019(2) dt.29-07-2019 2/2 Itahari, in the district of Saharsa, but no concrete steps have been taken.

The petitioner has remedy under the provisions of the Bihar Land Disputes Resolution Act, 2009. There is no clue from the writ application as to whether the petitioner has approached the Circle Officer under the provisions of the Bihar Land Disputes Resolution Act, 2009, and the Rules framed thereunder or not. It goes without saying that if he has not made application in accordance with the provision under the Act, he shall have liberty to make appropriate application under the Act read with the Rules framed thereunder. If he files an application accordingly, the competent authority shall have an obligation to dispose it of within the time prescribed under the Act. It is made clear that if the application, which has been filed by the petitioner, is in accordance with the provisions of the Act and the Rules framed thereunder, the same shall be disposed of expeditiously without any further delay in case there is no question of title involved.
