Petitioners seek bail in a case registered for the offences punishable under Sections 366A/34 of the Indian Penal Code and Section 8 of POCSO Act.

Submission is that statement of the victim girl would reveal that though she has alleged that she was kidnapped by Sumit Kumar and others but the matter appears to be of love affairs between the victim and Sumit. Sumit has already been allowed bail by the learned court below under Section 167 (2) of the Code of Criminal Procedure.

Considering the facts aforesaid, let the petitioners, above named, be released on bail on furnishing bail bonds of

Patna High Court CR. MISC. No. 36631 of 2019(2) dt.18-06-2019 2/2 Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Tarapur Police Station Case No.164 of 2018, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioners shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioners.
