1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Dalminagar Police Station Case No. 71 of 2024, disclosing offences under Sections 126(2), 115(2), 303(2), 124(2), 352, 351(2), 3(5) of the BNS, 2023.
3. As per the FIR, on 07.12.2024 in the morning, one Bhola Yadav arrived at the door of the informant, started abusing, for which the son of the informant objected him. Bhola Yadav started abusing the son of the informant also, and they started threatening to kill him. In the meanwhile, petitioner instigated the co-accused and threatened the son of the informant of dire consequences and scuffled with the
Patna High Court CR. MISC. No.37703 of 2025(2) dt.11-06-2025 2/3 informant's son. It has further been alleged that the wife of the informant intervened on which Bittu Kumar threw acid on her due to which she got burn injuries near her stomach.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to dispute between the parties inasmuch as a counter case has been lodged by the side of the petitioner bearing Dalminagar P.S. Case No. 72 of 2024 for an occurrence which has taken place on the same date and time. The allegation against the petitioner is that he entered into scuffle with the informant's son. The son of the informant has not sustained any injury and the injury has been sustained by the wife of the informant which is grievous in nature caused by acid. The allegation of throwing acid is not on the petitioner but on Bittu Kumar. Petitioner is having no criminal antecedent.
5. Having regard to the submissions made on behalf of the parties and taking into consideration the nature of allegation against the petitioner and the fact that there is a case and counter case between the parties, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of

No.37703 of 2025(2) dt.11-06-2025 3/3 his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Dehri, Rohtas, in connection with Dalminagar Police Station Case No. 71 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure/Section 482(2) of the BNSS, 2023.
