JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-01-2015 Heard learned counsels for the petitioner and the State. The petitioners being the father and brother of the husband of the complainant are apprehending arrest in a complaint case in which cognizance has been taken for the offences punishable under Section 498A of the Indian Penal Code. The accusation is of torture by demanding `1,50,000/- and the complainant was threatened that in case of non-fulfilment of demand, her husband will perform second marriage. It is submitted by learned counsel for the petitioners that the thrust of accusation is against the husband of the complainant who is in custody.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12
Patna High Court Cr.Misc. No.1906 of 2015 (2) dt.16-01-2015 2/2 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.DJ.M., Supaul in connection with Complaint Case No. 26C of 2012, subject to the conditions as laid down under Section 438(2) Cr.P.C.
