The petitioner, namely, Bido Yadav apprehends his arrest in Mansi P.S. Case No.80 of 2013 corresponding to G.R. No.931 of 2013 under Sections 341, 323, 504, and 34 of the Indian Penal Code and 3(i)(x) of the S.C./S.T. Prevention of Atrocities Act.

The prosecution case is that the petitioner with other coaccused persons assaulted the informant's wife on the order of the petitioner and then abused her.

The learned counsel for the petitioner submitted that the petitioner is next door neighbour of the informant and in connection with passage there is dispute between them and,

Patna High Court Cr.Misc. No.36713 of 2014 (2) dt.11-02-2015 therefore, this case has been lodged and in fact in the present case the provision of S.C./S.T. Prevention of Atrocities Act is not applicable.

Considering the above facts and circumstances of the case and the nature of allegation I direct the petitioner named above to surrender before the court below within one month from today and on his so surrendering the petitioner shall be released on bail on furnishing bail bond of Rs.5,000/-(rupees five thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Khagaria in connection with Mansi P.S. Case No.80 of 2013 corresponding to G.R. No.931 of 2013. (Mungeshwar Sahoo, J) Harish/- U
