The petitioner apprehends his arrest in Pirpainty P.S. Case No. 77 of 2012 registered under Sections 307, 326, 353 and other sections of the Indian Penal Code and Section 47(A) of the Excise Act.

The informant, an A.S.I. of police, alleged that while he along with other police officials was on patrolling duty he got information that country made liquor was being sold in Banchichak village. On such information, the house of the petitioner Bablu Baski was raided and 30 litres of country made liquor was recovered. It is alleged that thereafter the petitioner and other accused persons came and assaulted the informant Umesh Paswan with Dabiya. The informant got injury. No.22641 of 2016 (2) dt.28-07-2016 2/2 assaulted the informant with Dabiya which hit on his hand but, from perusal of the injury report, it would appear that the injury found on the hand of the informant was caused by a hard and blunt object and not by any sharp-edged weapon.

It appears that the informant is a police officer. He raided the house of the petitioner and recovered 30 litres of country made liquor made of Mahua. On such, the petitioner and others assaulted the informant causing different injuries. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail in Pirpainty P.S. Case No. 77 of 2012. Accordingly, the same is rejected.
