JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 18-04-2018 In compliance of this Court's order, dated 04.04.2018, the Chairman, Bihar School Examination Board, is present. A counter affidavit has been filed on his behalf stating inter alia that the required verification report of the certificate of the petitioner has been sent to the District Basic Education Officer, Kushinagar, Uttar Pradesh on 06.04.2018. Following is the relief sought for on behalf of the petitioner:- "That this is an application for issuance of appropriate writ/ writs, order/orders, direction/directions for commanding the respondent authorities for submitting the verification report regarding intermediate certificate of petitioner to his employer District Basic Education Officer, Kushinagar (U.P.) though query was made by the employer of

Patna High Court CWJC No.257 of 2018(4) dt.18-04-2018 2/2 petitioner on 19.12.2015 but till date matter regarding verification report of Intermediate certificate of petitioner has been kept pending however in case of other person verification report has already been submitted."

In view of the communication of the order, dated 06.04.2018, to the District Basic Education Officer, Kushinagar (Uttar Pradesh), this application has become infructuous. Mr. Siyaram Shahi, learned Counsel appearing on behalf of the petitioner has filed rejoinder to the counter affidavit. He submits that the order, dated 06.04.2018, is unsustainable.

Since the relief which the petitioner had sought in the present application no more survives, this application stands disposed of.

It goes without saying that the petitioner shall have the liberty to assail the order, dated 06.04.2018 in appropriate proceeding, in accordance with law.

Personal appearance of the Chairman, Bihar School Examination Board stands dispensed with.
