JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 20-03-2015 Learned counsel for the petitioners states that during the pendency of the present application petitioner No.3 has been arrested.

This application to the extent it relates to petitioner No.3 is dismissed as having become infructuous. This application for anticipatory bail as regards petitioner No.2 has already been permitted to be withdrawn by an order dated 18.11.2014.

Learned counsel for the petitioner, referring to the first information report, has submitted that there is no allegation against this petitioner except that he was a member of the mob of nearly 100-150 people and there is no allegation of specific overt act against him.

Patna High Court Cr.Misc. No.43090 of 2014 (3) dt.20-03-2015 2/2 It has been stated in paragraph 3 of the application that the petitioner has no criminal antecedent.

Keeping in view the submission, the petitioner No.1, namely, Pankaj Kumar, in the event of his arrest/ surrender within a period of six weeks from today shall be released on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief judicial Magistrate, Muzaffarpur in Sadar PS case No. 71/2014, subject to condition as laid down u/s 438(2) of the Code of Criminal Procedure.
