JUSTICE JYOTI SARAN) 09-08-2019 The petitioner complains of encroachment on a canal situated in Mauza- Jalalpur in the district of Patna. According to him it is illegally encroached thus adversely affecting the purpose for which it was created.

Though a submission is made that a complaint is filed before the Circle Officer, but no copy of the same is on record. In such circumstances and for the present, we dispose of the writ petition with liberty to the petitioner to file his

Patna High Court CWJC No.12625 of 2019(2) dt.09-08-2019 2/2 complaint before the Circle Officer, Danapur Circle or the authority concerned competent to entertain such complaint under the Bihar Public Land Encroachment Act,1956(hereinafter referred to as 'the Act') and it goes without saying that any such complaint shall be considered and disposed of in accordance with law by the statutory authority under 'the Act' preferably within a period of 6 months from the date of receipt/production of a copy of this order.

The writ petition is disposed of.
