After some arguments, learned counsel for the petitioner seeks permission to withdraw the Civil Miscellaneous petition with liberty to file petition in Miscellaneous Case No. 07 of 2017 for measurement and ascertainment of the land to the effect that the shop of the petitioner is not situated on Plot No.1275, Khata No.295, which is subject matter of the suit and decree rather the shop of the petitioner is situated on Plot No.1274, Khata No.297 and if such petition is filed, the learned court below shall dispose of the petition expeditiously.
Prayer is allowed.
