JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,324,379,504 and 506/34 of the Indian Penal Code.
The prosecution case is that on 6.2.2016 at 5 A.M. co accused Lali Devi started abusing the brother of the informant. On protest being made by the brother of the informant namely Sk. Nayeem, co accused Lali Devi assaulted with a piece of bamboo. In the meantime, the petitioner along with other co accused came and started assaulting the informant. It is further alleged that the petitioner assaulted on the head of the informant's brother with sickle and other accused snatched rupees ten thousand from the pocket of the informant.
Patna High Court Cr.Misc. No.23661 of 2016 (2) dt.26-05-2016 2/2 It is submitted by the learned counsel for the petitioner that though the injury caused to the brother of the informant Sk. Nayeem has been found to be grievous but the petitioner has also received grievous injury and the case lodged by the petitioner side is prior in time. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Katihar in connection with Amdabad P.S. Case No.14 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
