Heard learned counsel for the petitioner and learned A.P.P. for the State.

Learned counsel for the petitioner submits that the defects as pointed out by the office stand removed, as such the defects are ignored.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 352, 75, 109(1) and 3(5) of the Bharatiya Nyaya Sanhita. 4.

Learned counsel for the petitioner submits that petitioner has antecedent of one case and the informant alleges that on 8-8-2024 about 5 PM, while she was getting her paddy cultivated, when petitioner came in drunken state and started abusing her and when she objected, he took out a weapon from his waist and thereafter started acting inappropriately with her

No.43185 of 2025(2) dt.21-08-2025 2/3 daughter and on protest, he assaulted her daughter and when her husband and younger daughter came to save them, the petitioner assaulted both of them, further Jangali Ram and Rinku Kumar assaulted the informant and her daughter by sharp-edged weapon.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that on account of dispute relating to passage, an altercation had taken place, in which both sides assaulted each other. It is also submitted that entire family members of the petitioner stands implicated. It is further submitted that Jangli Ram and Rinku Kumari are father and sister of the petitioner. It is also submitted that from perusal of the injury report annexed as Annexure-2 series, it would manifest that the injury suffered by the injured is simple in nature, but as far as injury of Suchita Kumari is concerned, the doctor has reserved the opinion but then from perusal of the injury report, it would manifest that the same records - pain and swelling over left forearm, which is not vital part of the body. 6.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned

No.43185 of 2025(2) dt.21-08-2025 3/3 counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Mashrak P.S. Case No. 481 of 2024, subject to the conditions as laid down under Section 482 (2) of the BNSS.
