The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 420, 406 and other allied sections of the Indian Penal Code.

As per the FIR, the petitioners took Rs.13 lakh from the informant in the name of service in Secretariat, in which Rs.80,000/- had been deposited in the account of petitioners and the rest amount was given near the house of the petitioners. It is alleged that, when the informant asked the petitioners to return his money, then the petitioners abused and threatened him. 4.

It is submitted by learned counsel for the petitioners that

Patna High Court CR. MISC. No.39641 of 2023(2) dt.08-08-2023 2/3 petitioners are quite innocent and have committed no offence. They have been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. The allegation levelled against the petitioners is not specific rather general and omnibus in nature. It is submitted that not even a single document has been produced by the informant to show that he had given the Rs.13 lakhs to the petitioners. He further submits that petitioners took a loan of Rs.49,000/- from the informant and has already paid him the loan amount. Petitioners have no criminal antecedent, as also mentioned in para-3 of the bail application.

Learned APP for the State opposed the prayer for anticipatory bail.

Having regard to the facts and circumstances of the case as the present case is of money dispute and there is no evidence on record against the petitioners, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with
